TERMS:
PRESERVATION COVENANT
In consideration of the receipt of certain monies pursuant
to a grant received for the construction of a new jail
the County of Moultrie, by and through the County Board
hereby enters into a covenant regarding the former Sheriff’s
Office and Jail located at 14 North Hamilton Street,
in the city of Sullivan, the County of Moultrie, State
of Illinois and legally defined as
Lots 1, 2, 3 and 4 in Block 6 of the
Original Town, now City of Sullivan, Moultrie County,
Illinois

1. Moultrie County hereby covenants
on behalf of itself, its heirs, successors and assigns
at all time to maintain and preserve this property in
accordance with the recommended approaches of the “Secretary
of the Interior’s Standards for Rehabilitation
and Guidelines for Rehabilitating Historic buildings”
(National Park Service 1989) in order to preserve these
qualities that make this property eligible for listing
in the National Register of Historic Places.
2. No construction, alteration or rehabilitation
shall be undertaken or permitted to be undertaken that
would affect the historic features of the property without
consultation with and the express permission of the
Illinois Historic Preservation Agency (IHPA) or a fully
authorized representative thereof.
3. The IHPA shall be permitted at all
reasonable times to inspect the property in order to
ascertain if the above conditions are being met.
4. In the event of a
violation of this covenant, and in addition to any remedy
now or hereafter provided by law, the IHPA may, following
reasonable notice to the grantee, institute suit to
enjoin said violation or to require the restoration
of the property.
Illinois
Historic Preservation Agency will be available
11-8-07, 1 p.m. to tour the jail building. After
the tour at 2 p.m. a person from IHPA will meet
with county officials and prospective buyers to
explain the Preservation Covenant and how it will
apply to the sale of the jail building. |
AGREEMENT
FOR SALE OF REAL ESTATE
THIS AGREEMENT made
this _____ day of December 2007, by and between MOULTRIE
COUNTY, “Seller”, and __________________________________________________________________________,
“Buyer(s)”.
The parties agree as follows:
1. 1. Seller agrees
to sell to Buyer(s) and Buyer(s) agree(s) to purchase
from the Seller upon the terms and conditions in this
agreement the following described real estate, to-wit.
The property located at 14 N. Hamilton, Sullivan, Illinois,
61951 – The legal description of which is as follows;
Lots
1, 2, 3 and 4 in Block 6 of the Original Town, now City
of Sullivan,

2. Buyer(s) agree (s)
to pay to Seller ____________________________________

follows:

3. 3. Seller agrees
to execute a good and sufficient Warranty Deed conveying
said real estate to the Buyer(s) and to deliver the
deed and signed Real Estate Transfer Declaration to
the Buyer(s) at closing upon the Buyer(s) paying the
balance due on the sales price. Seller shall pay any
stamp tax imposed by law on the transfer of title.
4. 4. This transaction
shall be closed at the Moultrie County Courthouse, Sullivan,
Illinois, on or before _________________, or at such
other place and time as is mutually agreed to between
the parties at which time the Seller shall deliver the
Warranty Deed to the Buyer(s) paying the balance due
on the sales price.
5. Possession shall be delivered
to the Buyer(s) at closing.
6. 6. The 2007 real
estate taxes, payable in 2008, shall be prorated through
and including the date of closing, based on the latest
available tax information.
7. 7. Seller agrees
to furnish Buyer(s) with an Attorney’s Title Guaranty
Fund Title, Inc. title policy insuring Buyer(s) interest
in the real estate in the amount of the purchase price
subject to the standard title insurance policy exceptions
and exceptions provided for this agreement. The Buyer(s)
shall pay the cost of any endorsements requested by
the Buyer(s). Buyer(s) shall pay any mortgage title
policy required by the Buyer(s) lending institution.
In the event Buyer(s) make(s) a bona fide objection
to the merchantability of title to the real estate and
said objection cannot be cured or a title insurance
policy cannot be obtained and buyer(s) is/are willing
to accept such title as Seller can convey, then either
party may terminate this contract at which time Seller
shall promptly refund the down payment to the Buyers(s).
8. 8. Seller warrants
that no notice from any governmental unit of a dwelling
code or zoning code violation has been received by the
Seller or their agents prior to the execution of this
agreement.
9. 9. Buyer(s) acknowledge
that they are purchasing the property in “as is”
condition. Seller makes no warranties of any kind.
10. 10. Buyer(s) acknowledge
that they are aware that a Restrictive Preservation
Covenant has been placed on this property and are purchasing
this property with that knowledge.
11. 11. If the premises
are materially damaged by fire or other casualty before
this transaction is closed, Buyer(s) may, at their option,
(a) accept the insurance or other settlement and complete
the transaction, or (b) cancel this contract, in which
event the down payment made by Buyer(s) shall be refunded
to them. Seller shall, at her expense, keep the premises
insured by a responsible insurance company against loss
by fire or other casualty with extended coverage for
its full insurable value until this transaction is closed.
12. 12. The parties
further agree that the covenants and representations
made in this contract survive the closing.
13. 13. In event of
litigation, the defaulting or losing party shall pay
on demand reasonable attorney’s fees, costs and
court costs incurred by the prevailing party. Seller
shall not be liable for consequential damages.
14. 14. Two copies of
this agreement shall be executed and each executed copy
shall be considered as an original. One executed copy
shall be delivered to the Seller and one executed copy
to the Buyer(s).

Jail building only will
be offered for sale, followed by the 2 ½ car
garage (20’ x 28’), followed by the tower
(approximately 140’ steel tower). Buyer of the
garage and/or tower shall arrange their removal with
seller day of sale. If either garage or tower does not
sell, it will become property with the jail building.
The tower and garage can be sold without the provisions
of the Preservation Covenant. The sale of these 2 items
are considered public property and need to be paid in
full day of sale, along w/ a 3% Buyer’s Premium.
