TERMS: Successful bidder will sign a contract at the conclusion of the sale with a 10% down payment. The balance will be due within 30 days of the sale. Possession shall be given on the date of closing, subject to the right of the farm tenant to farm said ground for the 2010 crop year on a year to year cash rent farm lease. Buyer shall receive the cash rent for 2010. Any announcement day of sale takes precedence over any printed matter. Sellers reserve the right to accept or reject any and all bids.

TERMS AND CONDITIONS

CONTRACT: Successful bidder will sign a contract at the conclusion of the sale with a 10% down payment. The balance will be due on or before December 17th, 2009.

FINANCING: Bidding is not subject to buyer financing. Financing commitments should be secured prior to the auction.

TITLE: Title insurance policies in the amount of the purchase price, subject to standard and usual exceptions, will be furnished to the Buyer.

POSSESSION: Possession will be given at closing, subject to the right of the farm tenant to farm said ground for the 2010 crop year on a year to year cash rent farm lease. Buyer shall receive the cash rent for 2010.

ACREAGE: Total acreage is based upon U.S. Department of Agriculture Farm Service Agency Records.

MINERALS: All mineral rights owned by the Seller will be conveyed.

BIDS: The Sellers reserve the right to reject any and all bids.

REAL ESTATE TAXES: 2009 real estate taxes due and payable in 2010 shall be paid by the Seller to the Buyer at closing. It shall thereafter be the responsibility of the buyer to pay the 2009 taxes upon receipt of said tax bill and all subsequent taxes. All tax payments at closing shall be based on the last tax statement available.

SALES PROCEDURE: This tract will be offered to the highest bidder as final sale.

LEASE: The property is free of any previous tenant rights for the 2011 crop year.
