TERMS AND CONDITIONS

CONTRACT:

Successful bidder will sign a contract at conclusion of sale with a 10% down payment. The balance will be due on or before February 17, 2012, Friday at 10:00 a.m.

FINANCING:

Bidding is not subject to buyer financing. Financing commitments should be secured prior to the auction.

TITLE: A title policy in the amount of the purchase price, subject to standard and usual exceptions, will be furnished to the Buyer.
POSSESSION: Possession will be given at closing.
ACREAGE: Total acreage, 39.56, is based upon surveyed acres.
MINERALS: All mineral rights owned by the Seller will be conveyed.
BIDS: The Seller reserves the right to reject any and all bids.
REAL ESTATE TAXES: 2011 real estate taxes, payable in 2012 shall be paid by the Seller to the Buyer on the date of closing based on the latest tax information available, 2011 tax rate. 2012 real estate taxes and all subsequent tax years shall be assumed by the Buyer.
SALES PROCEDURE: The property will be offered to the highest bidder as final sale.
LEASE: The properties are free of any previous tenant rights for the 2012 crop year.
ANNOUNCEMENTS: All announcements on sale date shall have precedence over all printed material.
