TERMS AND CONDITIONS:

1. These tracts will be sold on a per surveyed acre basis. All tracts to be sold individually.
2. The successful bidders will be required to enter into a standard purchase agreement contract, with 10% of the purchase price due immediately following the auction. The balance will be due and payable on or before February 9, 2009.
3. Possession will be delivered to buyer at closing.
4. The 2008 real estate taxes, due and payable in 2009 will be paid by seller. All subsequent real estate taxes will be the responsibility of the buyers.
5. The seller shall provide a title insurance policy in the amount of the purchase price of the subject property.
6. The property is being sold in “AS IS” condition, with no implied warranties of any kind.
